"Subpoenas and Authorizations: Basics to Prevent Violations, Breaches, and Lawsuits"        

  • The Department of Health and Human Services (HHS) Office for Civil Rights (OCR) leverages fines and other actions against healthcare organizations and entities which do not follow HIPAA guidelines. Many of the actions can be prevented by ensuring your staff has a good understanding of authorizations, requests, and subpoenas. In this presentation, we will go back to the basics as a refresher on some of the areas that are often missed, including the Minimum Necessary Standard.

    Objectives:

    1. Define key HIPAA concepts related to authorizations, subpoenas, and the Minimum Necessary Standard.  

    2. Recognize common compliance pitfalls that lead to OCR investigations, breaches, and legal exposure.  

    3. Distinguish between different types of requests for health information and the appropriate response protocols.  

    4. Apply best practices to prevent violations when handling sensitive disclosures, especially in high-risk scenarios.     

BIO:

Darin Challacombe, Ph.D., SHRM-CP, is director of talent development at Verisma. He has worked in the health information (HI) and release of information (ROI) fields for eight years and has been in education for 20+ years. Darin’s vast experience includes work in nonprofit, government, and private business spaces. He serves as the Advocacy chair for the Kansas Health Information Management Association (KHIMA) and Education Chair of the Association of Health Information Outsourcing Solutions (AHIOS). Darin worked on the team to create the American Health Information Management Association (AHIMA) ROI Microcredential. He also serves as the Inclusion and Diversity chair for the Society for Human Resources Management (SHRM) Georgia. Darin earned his Ph.D. in psychology from Northcentral University, and his master’s and bachelor’s in psychology from Fort Hays State University.
